GENERAL INFORMATION
This Privacy Policy applies to personal data (hereinafter, the "Data") that we collect about you for the purposes of providing you with the services that we offer.
Namely: services relating to recruitment, the analysis and management of job applications through the site located at the address www.genius-people.com.
By using our site or communicating to us your data while using one of our online forms, you accept the practices described in this Privacy Charter. If you do not accept the provisions of this Charter, it is preferable not to use our site and not communicate your data.
In that case, you nonetheless accept not benefitting from all the services and other benefits offered by Genius People.

I. THE DATA COLLECTED DURING THE RESPONSE TO AN OFFER OF EMPLOYMENT
During the response to an offer of employment placed on the sites directly linked to www.genius-people.com, users are invited to fill out a form in which some fields are followed by an asterisk (*) and are required in order to be able to provide the requested service.
"User" means any person who makes use of the services.
Users who provide personal data to open a RECRUITER Account (RECRUITER Account) or respond to an offer of employment via the Site will also be referred to as "Candidates" later in this document.
People who create a RECRUITER Account and/or who access data of Candidates in the context of recruitment are also referred to as "Recruiters" later in this document.
The data communicated by the Users as well as those that will be linked to their use of our services will be processed by ANALIS , Genius People SPRL and Best2best human capital SPRL. They will be used for the delivery, the billing for our services (if the requested service is subject to a fee), as well as the management of our clientele and the production of statistics to help us improve our services. We are also likely to treat these data in the context of the prevention and management of fraud concerning the use of our services and, in the case of a dispute, for the defence of our interests.
II. DATA OF CANDIDATES DISCLOSED TO RECRUITERS
The Candidate who responds to an offer of employment may encode information concerning his identity (surname, first name, date of birth, etc.), his nationality, his contact details (mailing address and email address, phone number) and the data relating to his training, his professional career, his skills and his centres of interest.
Genius people allows a Candidate to reply to an advert without being registered. In that case, the data of the Candidate are stored on our database and operated solely by the RECRUITER Account linked to the advert by Genius People SPRL and Best2best human capital SPRL.
The Candidate's data will be exploited from the moment when the Candidate has decided to apply for the job. By default, the CV is "active" and "identifiable".
The Candidate agrees that these data be made accessible to the recruiters who receive access to this database and that these recruiters can, where appropriate, copy, save, print, and perform any processing operation on these data for recruitment purposes.
The Candidate agrees that his data can be accessed and processed by people located outside Belgium, or outside the territory of the European Economic Area, in a country that does not offer adequate or equivalent protection under Belgian and European legislation.
We ask recruiters who access the data from the CV database:
- To process these data only for the purposes of recruitment within the framework of their own business activities;
- To keep these data only to the extent necessary for those purposes of recruitment, with a maximum of 5 years from the date of receipt of the data in the CV database;
- To comply with the legislation applicable to him as the person responsible for processing.
However, the Candidate is aware that complete control of the use of the user is impossible and accepts the fact that GENIUS PEOPLE SPRL cannot control the way in which the authorized users store, use and transmit the data obtained through our services and we do not accept any responsibility in this regard.
The personal data of candidates are kept by GENIUS PEOPLE SPRL for 5 years from the date of the request for deletion of the CV in order to carry out statistics and studies on the use of our services for their optimisation and to be able to offer services or participation at events, under the conditions defined in Article II.
III. USE OF THE CONTACT DETAILS OF USERS
We will use the contact data provided by you, the user:
- To contact you in relation to and for the needs of the delivery and billing of our Services, including informing you of new features;
- To send you information about our services or events linked to the recruitment sector that we organise or promote, unless you, the user, do not wish to have it.
- To send you information about events or the services provided by other companies or events organized by third parties related to the recruitment sector, if the you, the user, has consented thereto.
- To offer you job opportunities that match your search criteria.
You can withdraw your consent to the use of your contact details at any time.
IV. COOKIES
GENIUS PEOPLE may use a technology called a "cookie". A cookie is an element of the information transmitted by the server that hosts the site to the user's browser, when accessing the site. Cookies are used to make the site function better and to analyse its use more precisely. For example, the site may install a cookie on its users’ browser which makes it possible for them to enter the Site without having to enter their password every time they do so.
It is advisable to accept the cookies of GENIUS PEOPLE SPRL, because they will enable you to take advantage of certain features of the site.
V. CONFIDENTIALITY AND SECURITY
Confidentiality. We undertake to maintain the strictest confidentiality concerning the personal data that we store and process in relation to the services and not to disclose them to third parties unless necessary for the performance of the services or we are required to do so by law. We make every effort to ensure that this obligation is fulfilled by our staff, agents or potential subcontractors.
Data storage and security. GENIUS PEOPLE SPRL will take all the reasonable technical measures in line with current technology to protect personal data against accidental or unauthorised destruction by third parties, against accidental loss, as well as against unauthorised modification, access or any other processing by third parties. However, we cannot guarantee that these data will not be accessed by third parties in the case of computer hacking or software pirating.
As regards the services of data storage, the servers on which are stored the data associated with the RECRUITER accounts located on the territory of the European Economic Area or in a country providing an adequate level of protection according to the criteria of the Law of 8 December 1992 on the protection of personal data. You can ask us at any time for information about where these data are stored.
We can engage third party companies and sub-contract their services or rent a facility from them for storing data. In this case, we require the subcontractor or third party to observe obligations of confidentiality and security equivalent to those offered to the Client within the framework of the present general conditions as regards the security and confidentiality of the data.
The user whose data are stored by us may at any time request a written description of the technical and organisational measures implemented to ensure the confidentiality and security of data by sending a written request to this effect to the following address: Rue Emile Francqui, 7F - B-1435 Mont-Saint-Guibert. We are likely to omit in this description the elements or technical details, the disclosure of which could be detrimental to the security of the data.
By using our services, the user acknowledges that:
- He has been sufficiently informed of the technical and organisational measures that we take to ensure the security and confidentiality of his data so that they are adequately protected, in line with current technology, against accidental or unauthorised destruction by third parties, against accidental loss, as well as against unauthorised modification, access or any other processing by third parties;
- That these measures are sufficient and adequate with regard to the data that the user stores in the context of the services.
Attempts to hack the data. If a user discovers an incident in which there was an attempt to hack into the security of the data, he undertakes to inform us about it as soon as possible by sending an email to the following address: privacy@genius-people.com.
VI. RIGHT OF ACCESS TO, CORRECTION AND DELETION OF DATA
Data accessible via the Accounts. A user who has created a CANDIDATE folder or a RECRUITER Account may consult and modify or delete his personal data at any time, . It is sufficient for him to connect to his Account, go to his profile and make the desired changes or deletions as appropriate.
However, if third parties have had access to the personal data of a user, who has in the meantime consulted, modified, or deleted them, GENIUS PEOPLE SPRL cannot modify or delete those data from their systems.
Data in the CV database. The data are in the CV database as long as you have a RECRUITER Account and it is active.
We will delete your data from the CV database by the statutory deadline or upon express request for cancellation. In addition, we reserve the right to remove your data from the CV database at any time if we believe that the data you have transmitted violate the rules of this Charter or our Conditions of use ;
The Candidate is aware that the deletion of his data from the CV database does not imply the deletion of those data by the people who accessed the data before their deletion and who are likely to continue processing those data.
Other personal data. Any user can exercise his rights of access, correction and objection regarding his personal data. For the personal data that we process, and which may not be consulted, corrected or deleted directly by the user through the functionality of the services, the user can send a request for access, correction or opposition by letter posted to the following address: Genius People SPRL, Service Privacy, Rue Emile Francqui, 7F - B-1435 Mont-Saint-Guibert.
Proof of his identity will be required, which means he must include a copy of his identity card. The request must be dated and signed. GENIUS PEOPLE SPRL will respond to this request within the period laid down by the Belgian and European legislation regarding data protection.
VII. MODIFICATION OF OUR POLICY IN RELATION TO DATA PROTECTION
GENIUS PEOPLE reserves the right to update and amend the terms of its policy with respect to the protection of data, at any time and regularly, subject to prior information. The updated version of this policy will always be available on the site. The use of the Site or the Services after the amendments or revisions of the Policy signifies acceptance of the amended or revised Policy.
VIII. APPLICABLE LAW
Our commitments and requirements in terms of protection of personal data are subject to Belgian and European legislation relating to the protection of data of a personal nature.
These provisions will be governed, interpreted, performed in accordance with Belgian law, the only law applicable in case of disputes. Any dispute which cannot be settled amicably within a period not exceeding one month from the date of its occurrence, this time limit being extendible by mutual agreement, may be brought by the first party to take action before the French language Courts and Tribunals of the judicial district of Nivelles which alone have jurisdiction.
IX. DATE OF ENTRY INTO FORCE
This policy was created and entered into force on 16/05/2018. We reserve the right, at our sole discretion, to change, modify, add or remove parts of the present policy at any time.
